This Service and Usage Agreement ("Agreement") is entered into electronically between the service provider operating under the brand Hosting Server, officially registered as Disket Telekom LTD ŞTİ ("Company"), and any individual or legal entity purchasing services via the website ("Customer").
1. Electronic Acceptance and Enforceability
By placing an order, making payment, or starting to use the service through the website, the Customer declares that they have read, understood, and accepted all terms of this Agreement. This Agreement is binding in electronic form.
2. Parties and Service Description
The Company provides the following services:
- Web Hosting
- VDS / VPS (Virtual Server)
- GPU Server
- Dedicated (Physical) Server
All services are hosted in data centers located in Turkey / Bursa.
3. Account Creation and Security
The Customer is obliged to provide accurate and up-to-date information and must maintain a valid email address. Password security is entirely the responsibility of the Customer. The Company is not liable for damages resulting from unauthorized access.
4. Service Level and Uptime
The Company guarantees 99% annual uptime. Force majeure, scheduled maintenance, and customer-related issues are excluded from this calculation.
5. Usage Rules and Prohibited Activities
- Spam sending
- Cryptocurrency mining
- DDoS attacks
- Adult content
- Torrent services
- Game servers
- Cryptocurrency nodes
- Illegal content
Violation may result in immediate termination of the service without notice or refund.
6. Abuse Notifications
All abuse notifications must be responded to within 24 hours. Failure to comply may result in service suspension or termination.
7. Resource Usage
Excessive CPU, RAM, or disk usage that affects the infrastructure may result in automatic throttling.
8. Backup and Data Loss
Backup services are not mandatory. The Company is not responsible for data loss. Dedicated servers do not have automatic backup.
9. Payment and Suspension
All services are prepaid. Services may be suspended or deleted if the payment due date is exceeded.
10. Refund Policy
Web Hosting and VDS/VPS services have a 7-day refund guarantee. GPU and Dedicated services are non-refundable.
11. Technical Support Scope
Support is limited to infrastructure services. Script installation, software development, and third-party applications are outside the scope of support.
12. Indemnification
The Customer agrees to hold the Company harmless from any administrative fines, lawsuits, or third-party claims arising from the use of the service.
13. Governing Law and Jurisdiction
All disputes shall be subject to the jurisdiction of the Istanbul Courts and Enforcement Offices.
14. Right to Amend
The Company reserves the right to update or modify this Agreement unilaterally at any time.
